Male only draft ruled unconstitutional
« on: February 25, 2019, 10:47:07 PM »
Story.

Quote
A federal judge in Texas ruled Friday that the military's male-only draft is unconstitutional.

The challenge was brought up by a group known as the National Coalition for Men and two men subject to the registration requirements.

The Selective Service System had upheld the draft requirement, citing a 1981 Supreme Court ruling that women could be excluded due to not being "similarly situated" with men for draft purposes.

In the decades since that ruling, women's rights in the military have expanded.

Federal Judge Gray Miller wrote in his Friday ruling that "in 2013, the Department of Defense officially lifted the ban on women in combat."

He said that, likewise, the draft should apply to both men and women.

But he hasn't issued an injunction against the federal policy, meaning it will remain in place on appeal.
Truten forever!

^^^no, thats not happening nor is it feasible.

As someone who’s actually served in the Army i have no problem w. women being excluded. They can contribute as they did in WWII, taking up the slack on jobs on the home front, and various other support activities. That and taking care of the children.

Not having the draft is possible.  Moral issues aside, I know the infantry is getting outdated due to the advancement of technology.  Eventually, the military won't need a draft as they already have plenty of volunteers.  The rest is done remotely.

This is what they asked for. Now they can finally earn their keep instead of stealing Government benefits from people forced into stormtrooper service to gain things like federal student aid.

And of course it'll never truly work. Since they aren't built or this. But now they'll learn the hard way.

Arguing for getting rid of the draft because we have enough volunteers is flawed because the whole purpose of the draft is that it’s for worst case scenarios where we need manpower beyond what we normally have. Better to have it and not need it.

As for women in combat roles, I find it hard to believe that anyone honestly thinks women and men on average would be comparable in combat. Yes, the top 0.1% of women may physically be able to do the job. But the purpose of the military isn’t to train the top 0.1%, it’s to take the average citizen and make them into a soldier. Weeding out 20-30% is a lot different from weeding out 99%. Inevitably, there will be pressure to lower standards so more women can pass. And mixed gender combat units sounds like a disaster. This is the type of project that is only entertained by a nation feels utterly safe, and whose general population is insulated from war by the volunteers.

^^^good post.

Lets face it, women are the weakER sex, which is not to say they're WEAK.
I’ve served w. both men & wonen in combat, and both, on average, did what was needed/whined just as much.
Any way, support MOS’s and keeping shit running at home’s just as important as kicking ass.
Never met a Soldier who begrudged women not being draft-able.

Actually, my argument was that our technology is advancing enough that infantry is not needed.

This is the logical destination of a society that favours egalitarianism over meritocracy. If you favour meritocracy, it's obvious that women shouldn't be in the military in anything like the same numbers as men, since on average they're physically inferior to men by some distance. If you favour egalitarianism though, it's hard to justify advocating for inequality when it comes to the draft. It's also the thin end of a wedge, since if you accept that women aren't as capable of certain military roles as men, it raises the question of whether there are other jobs they aren't as capable of either (police officers or firefighters, for example). And no politician or public figure wants to open that can of worms.

A quick google search can name at least 48 other countries that have inducted females into their militia.

China. Pakistan. Israel. South Korea. Italy. Russia. Poland. Czech Republic. Australia. Indonesia. Uk. Canada. Taiwan. Norway. Estonia. Portugal. Peru. Serbia.....

How many of those use women in direct combat roles, I.e. infantry? Not just in training but in practice?

Well, according to Google...

*Israel-It's compulsory for both male & female to join the Israeli Defence Forces between the age of 18-21. Women are drafted in all units except   Special Forces. Women make up 31% of the military forces.

*France- In 1972 women were deemed equal to male soldiers.

*Finland- Same training & duties as male soldiers.

*Sweden- Able to join all units including Special Forces & combat divisions.

*Ireland- Able to join Special Forces & combat roles in The Irish Army.

*Estonia- Opened up all units to females to enter conscript services.

*S/Korea- 8000 females in the military but NOT ALLOWED to fight in the frontline.

*Romania- In the 2008 Iraq War, the Romanian Army sent 50 women to fight as well as in Afghanistan.

*Pakistan- Women are primarily trained as pilots. Once training is completed they can move into infantry warfare & sniper missions.

*Russia- During WW1, there was apparently the infamous Women's Death Brigade.

*New Zealand- Sent female soldiers to fight in Afghanistan.

No draft.

Forcing people to fight is fucking tyrannical.

No way would the U.S. public ever support a draft at this period of time.
