Is any of trump Law suits going to hit him
« on: October 06, 2018, 12:37:53 AM »
Decided not to put this in the Trump sucks thread. Since this more talking about legal matters and the law

https://www.rawstory.com/2018/09/bad-news-trump-emoluments-clause-lawsuit-just-major-win

I always said the easiest case against him is the emmoluments clause. Is they been working against them since day 1.

More and more case been against him. The Question will any of them hit

And that not counting if they go after the fraud stuff, in the times..if that turns out to be true. He been plenty Teflon so far

A lot of it won't affect him unless he's out of office.

if the tax fraud prove true. He may not have anything happen to him since it happen to long ago, where they cant charge him. Think the time frame for fraud is 4 year. Now if he has to pay the back Taxes, well that another thing.

I don't think there's a limit on taxes.   They want their money & if it's a federal thing they'll also look at his more recent dealings which could turn up more recent crimes.   Which,  he could be held accountable.  Can't be a president when you're in jail.

the ability to prosecute him may be taken to the supreme court though

About to get the specific code on this.

Ah, here we go!

https://klasing-associates.com/question/difference-criminal-tax-evasion-and-civil-tax-fraud-offense/

"Moreover, civil tax fraud and criminal tax fraud have different statute of limitations. For civil tax fraud, there is no statute of limitations, and the tax may be assessed at any time. By contrast, there is a criminal statute of limitations, but it applies only to the prosecution of the crime—the actual tax evasion—not the assessment of the tax owed. Typically, the statute is three (3) years after the taxpayer commits the offense. But there are certain, specified carved out offenses for which a six (6) year statute of limitations applies."

The worst was Trump university, which has settled. To be clear, Trump has lost a lot of lawsuits in the past because he always tried to get out of paying what he owed. Of the current lawsuits, the emolument clause one at least got past the motion to dismiss stage in a federal court. But the real test will be whether it survives the federal appellate courts.

The bigger question is whether there ends up being enough evidence of a financial crime that Trump gets indicted once he leaves the White House ... although there's a possibility his age will prevent that.
